A US federal court is unlikely to reject the Department of Justice’s (DOJ) request to dismiss the criminal case against Indian billionaire Gautam Adani, according to legal experts. The experts said it would be highly unusual for a court to force prosecutors to continue pursuing a case after the executive branch has decided to withdraw the indictment.

The DOJ has submitted a request seeking dismissal of the case, citing detailed legal and policy reasons behind its decision. Under Rule 48(a) of the Federal Rules of Criminal Procedure, prosecutors require court approval before an indictment can be formally dismissed.

Legal experts noted that while judges have the authority to seek additional information, review the circumstances or conduct hearings before granting approval, there is limited modern precedent for courts compelling the government to proceed with a criminal prosecution it no longer wishes to pursue.

The case involving Gautam Adani had attracted significant attention, but legal analysts believe the court’s role in such matters is generally limited, particularly when prosecutors provide a clear justification for ending a case.

Experts said the final decision rests with the federal court, which may examine whether the dismissal request is appropriate under legal standards. However, given the Justice Department’s stated position and existing legal practice, they expect the request to be approved. The development highlights the balance between judicial oversight and prosecutorial discretion within the US criminal justice system.
